Some dismissals occur because of workplace misconduct – a theft, a fall in productivity, insubordination, an assault – whose cause has an underlying nexus to an employee’s mental health. In such cases, the union may challenge the firing on the grounds that the employer played insufficient attention to tell-tale signs of the employee’s distress.
